On October 17, 2019, in Docket No. EL18-61-000, the Commission issued an order denying the complaint of Public Citizen, Inc. (Public Citizen). The Commission disagreed with Public Citizen’s allegations that PJM potentially violated the FPA, Commission precedent, and the PJM Operating Agreement by recovering through its Commission-approved filed rate improper campaign contributions and lobbying expenses, and by failing to disclose its spending on political activity. The Commission concluded that Public Citizen has failed to demonstrate that the fees paid by PJM to the Democratic Governors Association and the Republican Governors Association are unrecoverable under the applicable standard. The Commission found that such costs are legitimate expenses approved by the PJM Finance Committee in the interest of PJM stakeholders and that such costs are recoverable.

On October 17, 2019, in Docket No. EL14-37-000, the Commission issued an order requiring additional briefing pertaining to the issue of how uplift is, or should be, allocated to all virtual transactions. In light of the changed circumstances since the time that pleadings were last submitted in the docket and to update the record, the Commission is requiring PJM to submit a brief answering the questions listed in the order by November 18, 2019. Parties may then file reply briefs updating their positions within 30 days of PJM’s filing.

On October 17, 2019, in Docket Nos. ER19-469-000 and ER19-469-001, the Commission issued an order on compliance filing, instituting Section 206 proceeding and establishing paper hearing. In its order, the Commission found that PJM’s Order No. 841 compliance filing generally met the requirements of Order No. 841, and directed PJM to submit a further compliance filing with additional Tariff and Operating Agreement revisions within 60 days. Additionally, the Commission initiated a proceeding, under section 206 of the Federal Power Act, in Docket No. EL19-100-000, and required PJM to submit, within 45 days of publication of notice in the Federal Register, Tariff and Operating Agreement revisions reflecting its rules and practices regarding minimum run-time requirements for all resources, and an initial brief addressing whether PJM’s application of its minimum run-time rules and practices to Capacity Storage Resources is just and reasonable and not unduly discriminatory or preferential.
